1. Who we are

This website, www.elizabethholland.co.za, is operated by Elizabeth (Ilze) Holland, trading as “Elizabeth Holland – Counselling, Coaching & Hypnotherapy” (“I”, “me”, “my”), based in the Helderberg, Cape Town, South Africa. I am the responsible party for your personal information and also the Information Officer.

2. My commitment

I respect your privacy and am committed to protecting your personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA). This policy explains what I collect, why, how I keep it safe and what your rights are.

3. What personal information I collect

  • Contact information: your name, email address, phone/WhatsApp number, and general location (e.g. city or country), when you complete a form, book a call, sign up for my free audio or contact me.
  • Booking and payment information: session dates, the service booked, and payment records. Payment is by cash or EFT; I do not collect or store card details.
  • Session information: notes about what you share with me during sessions, which may include information about your wellbeing, health, relationships, religious beliefs or personal history. Under POPIA, some of this is “special personal information” and I only process it with your explicit consent, for the purpose of providing my services to you.
  • Consent forms for clients under 18: the name and contact details of the parent or legal guardian, and their signed consent.
  • Website information: basic technical information such as your IP address, browser type and pages visited, collected through cookies and, where used, website analytics tools.

4. Why I use your information

  • To respond to your enquiries and book sessions
  • To provide coaching, hypnotherapy and Wellness Counselling sessions, and keep appropriate session records
  • To send you the free audio and, if you’ve agreed, occasional emails with encouragement, resources and updates
  • To manage payments, invoices and my business records, and to comply with legal obligations (e.g. tax)
  • To improve my website

I will only use your information for the purpose it was collected for, or a closely related purpose, unless you give further consent or the law requires it.

I will only send you marketing emails if you have opted in. Every email includes an unsubscribe link, and you can also ask to be removed at any time by emailing me.

6. Who I share your information with

I do not sell or rent your personal information. I only share it where necessary with trusted service providers (“operators”) who help me run my business, for example:

  • My email newsletter provider
  • My online booking/scheduling tool
  • Video-call platforms (such as Zoom, Google Meet or WhatsApp)
  • My website hosting provider
  • My bank (for EFT payments)
  • My accountant or bookkeeper, where applicable

These providers may only use your information to provide their services to me and must keep it secure.

I may also disclose information if required by law, or if I believe there is a serious and imminent risk to your life or safety, or someone else’s.

7. Information sent outside South Africa

Some of the tools I use (for example, email, scheduling or video-call platforms) may store information on servers outside South Africa. Where this happens, I take reasonable steps to make sure the provider offers an adequate level of protection as required by section 72 of POPIA.

8. How I keep your information safe

I take reasonable technical and organisational measures to protect your information, including password-protected and secured devices and accounts, limiting access to session notes to myself only, and using reputable service providers. No method of transmission over the internet is completely secure, so please avoid sending sensitive information through the website contact form.

9. How long I keep your information

I keep personal information only as long as needed for the purpose it was collected, or as required by law. Session records are kept for 5 years after our last session; financial records for 5 years, as required for tax purposes; and mailing-list details until you unsubscribe. After this, information is securely deleted or destroyed.

10. Children

I welcome clients under 18, but only with the consent of a parent or legal guardian and a consent form signed by them before the first session. Personal information about a child is collected and used only with that consent, and only to provide and manage their sessions. My website, newsletter and free audio are intended for adults, and I do not knowingly collect personal information from children without the consent of a parent or legal guardian.

11. Cookies

This website uses cookies to make it work properly and, where analytics are used, to understand how visitors use it. You can set your browser to refuse cookies, though some parts of the site may not work as well.

12. Your rights

Under POPIA, you have the right to:

  • Ask whether I hold personal information about you and request access to it
  • Ask me to correct or update inaccurate information
  • Ask me to delete information I no longer have a lawful reason to keep
  • Object to the processing of your information, including for direct marketing
  • Withdraw your consent at any time (this won’t affect processing that took place before you withdrew it)
  • Lodge a complaint with the Information Regulator

To exercise any of these rights, email hello@elizabethholland.co.za. I may need to confirm your identity before acting on your request.

13. Complaints

If you have a concern, please contact me first so I can try to resolve it. You also have the right to complain to the Information Regulator (South Africa). Current contact details and complaint forms are on the Regulator’s website: www.inforegulator.org.za

14. Changes to this policy

I may update this policy from time to time. The latest version will always be on this page, with the date it was last updated.
